If defective digital content that we have supplied to you damages a device belonging to you and this is caused by our failure to use reasonable care and skill, we will either repair the damage or pay you compensation. However, we will not be liable for damage that you could have avoided by following our advice to apply an update offered to you free of charge or for damage that was caused by you failing to correctly follow instructions on the Site or to have in place the minimum system requirements advised by us.

Restrictions.

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

You must not establish a link to our Site on any website that is not owned by you.

Our Site must not be framed on any other site, nor may you create a link to any part of our Site other than the home page.

Breach of these Terms of Use.  

When we consider that a breach of these Terms of Use has occurred, we may take such action as we deem appropriate including, without limitation, immediate, temporary or permanent withdrawal of your right to use our Site or its Content and/or taking legal action against you.

Law and jurisdiction. 

Governing Law.  These Terms of Use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. 

Jurisdiction.  We each irrevocably agree that the courts of England shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms of Use and all matters arising from it (including any dispute relating to the existence, validity or termination of these Terms of Use or any contractual or non-contractual obligation).

Our trade marks.

The trade marks that appear on the Site may be registered in the UK and/or elsewhere. 

You are not permitted to use our trade marks without our approval, unless they are part of Content that you are using as permitted under and in accordance with these Terms of Use.
